Direction to Pay & Assignment of Insurance Proceeds
I acknowledge that if my insurance company issues payment to me for repairs to my vehicle, I remain fully responsible for ensuring those funds are delivered to Hail Center. No vehicle will be released until Hail Center has received and confirmed payment in full.
I hereby irrevocably authorize my insurance company to issue all payments including supplements directly to Hail Center. I agree to promptly execute any Direction to Pay or Assignment of Proceeds form required by my carrier, and I acknowledge that my failure or refusal to do so does not reduce or delay my payment obligations under this Agreement.
If a lienholder is included on any payment draft, I am solely responsible for coordinating endorsement or re-issuance prior to vehicle release. Storage charges continue to accrue during any lienholder delay.
Work Authorization & Repair Method Discretion
I authorize Hail Center to perform paintless dent repair (PDR) and related services on my vehicle, including operating it for movement, testing, subcontracted services, detailing, and transportation.
I authorize Hail Center to communicate with my insurance provider and process supplements as necessary. Unless otherwise requested in writing, I authorize disposal of damaged or replaced parts.
Repair Method Discretion — Repair vs. Replace
Hail Center retains sole discretion to determine the appropriate repair method for each panel or component, including whether a part is repaired or replaced. Insurance estimates and supplements are pricing and scope documents only. A line item written as “replace” by an insurance carrier does not obligate Hail Center to replace that part if, in Hail Center's professional judgment, it can be properly repaired to industry standards. Likewise, Hail Center may replace a part written as “repair” if repair is not feasible.
Repair method decisions are based on damage severity, part condition, structural integrity, parts availability, and industry-accepted PDR and repair standards. Any difference between the insurance-written repair method and the method actually performed does not reduce the amount owed to Hail Center, alter the customer's payment obligations, or entitle the customer or insurance carrier to any refund, credit, or offset.
Hail Center's final repair documentation and billing will accurately reflect the repair methods actually performed. Any adjustment to line items will be handled through the supplement process with the insurance carrier. The agreed price for the completed repair is not reduced by Hail Center's election of repair method.
Prior Damage & Vehicle Condition
Pre-existing damage not related to my insurance claim will not be repaired unless separately agreed in writing. Hail Center may document vehicle condition through photographs and written notes at intake.
In any dispute regarding alleged damage, the burden of proof rests on me to provide dated, verifiable evidence of the vehicle's prior condition.
Administrative & Insurance Processing Fees
The following fees are billable regardless of whether repairs are ultimately completed, covering intake, inspection, imaging, estimate preparation, insurance communication, and file management.
| Standard Administration Fee | $250.00 |
| Standard Estimating / Insurance Consultation Fee | $250.00 |
Storage & Lot Usage
Storage charges begin on the date of vehicle drop-off regardless of whether active repair work has commenced.
| Indoor Secured Storage | $250 / day |
| Outdoor Secured Storage | $150 / day |
Charges accrue daily until the vehicle is released upon full payment. I assume all risk associated with outdoor storage including weather events. I am personally responsible for all storage fees if insurance denies, delays, underpays, or fails to pay for any reason.
Vehicle Protection & Loss Mitigation Services
I authorize Hail Center to perform protective services including crash wrapping, weatherproofing, interior protection, and debris removal as needed. These are billable to my insurance claim.
| Crash Wrap (windshield, back glass, sunroof — per piece) | $35 / piece |
| Crash Wrap Labor / Prep (per section) | $83 |
| Debris Removal / Interior Protection | $83 |
I am personally responsible for all vehicle protection fees if insurance denies, delays, underpays, or fails to pay for any reason.
Towing & Transport
If towing or transportation is required, I authorize Hail Center to coordinate these services on my behalf. All charges are billable and may be submitted to my insurance carrier. I am personally responsible for any towing or transport fees if insurance denies, delays, underpays, or fails to pay for any reason.
Total Loss Fees
If your vehicle is declared a total loss, Hail Center will submit all incurred fees to your insurance company for payment. However, if your insurance company denies, delays, or fails to pay any of those fees, you are personally responsible for the balance.
You are required to notify Hail Center in writing within 5 business days of a total loss determination. Storage fees continue to accrue every day until your vehicle is physically removed from the property. Hail Center is not involved in the total loss negotiation between you and your insurance company and has no obligation to reduce or waive any charges based on what your carrier decides to pay.
Fees you remain personally responsible for if insurance does not cover them:
- Administration fee: $250
- Estimating / insurance consultation fee: $250
- Storage from drop-off through the date the vehicle is removed — $250 per day indoor, $150 per day outdoor
- Any vehicle protection services performed — $35 per crash wrap piece, $83 per section for labor
- Any towing or transport coordinated on your behalf
Accepted Forms of Payment
Hail Center accepts insurance drafts, certified cashier's checks, cash, and debit or credit cards. A 3% processing fee applies to credit card transactions only and will be disclosed at the point of sale and itemized on the receipt. Debit card transactions are not surcharged. The credit card processing fee is non-negotiable.
Customer-Handled Insurance Claims
If a customer elects to pay Hail Center directly and seek reimbursement from their carrier independently, they are fully responsible for payment in full regardless of any reimbursement delay or denial. Payment must be made before vehicle release.
Verbal, written, or electronic approval of an estimate — including via email or text — constitutes full authorization to commence repairs and order necessary parts.
Estimate-Only Service Fee
If a customer requests an estimate and insurance submission without committing to repairs at Hail Center, a flat fee of $1,000.00 is due at time of service.
| Estimate & Blueprint Preparation | $500.00 |
| Digital Documentation, Photography & Insurance Submission | $500.00 |
Non-refundable. If the customer proceeds with repairs at Hail Center, the $1,000.00 will be credited toward the customer's repair balance. Not transferable.
Payment Responsibility & Vehicle Release
I am ultimately responsible for all charges regardless of insurance outcome. Insurance delays do not reduce, waive, or offset any charges accruing during such delay. I am personally responsible for all outstanding balances if insurance denies, delays, underpays, or fails to pay for any reason.
Cancellation Fees
If you choose to cancel after dropping your vehicle off, you are responsible for paying all of the following:
- Administration fee: $250
- Estimating / insurance consultation fee: $250
- Storage fees from the date of drop-off until the vehicle is picked up — $250 per day indoor, $150 per day outdoor
- Any vehicle protection services performed — $35 per crash wrap piece, $83 per section for labor
- Any towing or transport coordinated on your behalf
Artisan's Lien — RSMo § 430.020
This Agreement constitutes the written memorandum required under RSMo § 430.020 to establish and perfect Hail Center's artisan's lien on the vehicle. In addition to all statutory lien rights, I expressly grant Hail Center a contractual possessory lien on the vehicle securing all charges, fees, and expenses incurred under this Agreement, including administrative, estimating, storage, vehicle protection, towing, and cancellation charges.
In the event of non-payment — whether by insurance or by the customer — Hail Center may retain possession and pursue all legal remedies including enforcement of lien rights, recovery of collection costs, attorney's fees, and court costs. Customer remains personally liable for all fees and costs regardless of insurance outcome.
Warranty, Liability, Insurance & Risk of Loss
Workmanship Warranty
Hail Center warrants its paintless dent repair workmanship against defects for as long as the customer owns the vehicle. This warranty covers repair of defects in work performed by Hail Center and does not cover new or subsequent damage, pre-existing conditions, or work performed by subcontractors.
Subcontracted Services
Glass, paint, and body work are performed by independent subcontractors and are covered exclusively by the applicable subcontractor's warranty. Hail Center assigns and passes through all such warranties to the customer.
Risk of Loss
Hail Center is not responsible for loss or damage due to fire, theft, vandalism, weather, hail, acts of God, or causes beyond its reasonable control while the vehicle is stored on its premises. I represent that my vehicle carries comprehensive insurance coverage throughout the repair and storage period, and I agree to look first to that coverage for any such loss.
Aged & Brittle Components
Repairs may require removal and reinstallation of interior trim, headliners, moldings, clips, and fasteners. These components become brittle with age, heat, and sun exposure. Hail Center is not responsible for breakage of aged, brittle, or previously damaged components that occurs during removal or installation performed with reasonable care, or for the cost of replacement parts required as a result.
Electrical Systems & Batteries
Repairs may require battery disconnection or component removal. Hail Center is not responsible for lost radio presets or module settings, required system relearns, pre-existing battery weakness, or latent electrical or mechanical conditions that become apparent during or after repair.
Water Intrusion
Work involving glass, moldings, or roof components may disturb factory seals whose condition reflects vehicle age and history. Hail Center is not responsible for water intrusion attributable to pre-existing seal degradation.
Entire Agreement, No Oral Modifications & Severability
This Agreement constitutes the entire agreement between the parties. It may not be amended except by a written instrument signed by an authorized representative of Hail Center. No employee or agent has authority to modify these terms orally.
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be enforced to the maximum extent permitted by law.
Governing Law, Venue & Attorney's Fees
This Agreement is governed by the laws of the State of Missouri. Any dispute shall be resolved in the state or federal courts in the county where Hail Center's facility is situated. The prevailing party in any enforcement action shall be entitled to recover reasonable attorney's fees, court costs, and collection expenses.
